AROLUX Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the AROLUX mobile application, website, and all related services (“AROLUX”, “we”, “us”, or “our”). By using the app, you agree to comply with and be bound by these Terms. This agreement applies to all users, including Passengers (Riders), Drivers, and any other individuals accessing our Services.


1. Eligibility

  • You must be at least 18 years old to use the app.
  • Drivers must hold a valid U.S. driver’s license, meet vehicle and insurance requirements, and pass background checks and vehicle inspections.
  • Use of the platform must comply with local, state, and federal laws.

2. Account Registration

  • Users must register with accurate personal details and maintain up-to-date information.
  • You are solely responsible for maintaining the confidentiality of your login credentials.
  • Any unauthorized use of your account must be reported immediately.

3. Nature of Relationship

  • Drivers are independent contractors, not employees of AROLUX.
  • AROLUX does not control the hours, routes, or manner in which drivers operate.

4. Booking, Fares, and Payments

  • Fares are calculated based on distance, time, demand (surge), tolls, and applicable taxes.
  • All payments are processed electronically through the app.
  • Riders authorize AROLUX to charge the default payment method upon confirming a ride.
  • AROLUX reserves the right to adjust fares post-trip in case of errors or disputes.

5. Cancellations & No-Shows

  • Riders may cancel a ride within a grace period; late cancellations or no-shows may result in a fee.
  • Drivers may also cancel rides, but excessive cancellations may lead to penalties or deactivation.
  • Riders and Drivers must be present at pickup within a reasonable time window to avoid charges.

6. Ratings and Feedback

  • Both Riders and Drivers can rate each other after each trip.
  • Repeated low ratings may lead to account review or deactivation.
  • Feedback must be respectful, truthful, and non-discriminatory.

7. Community Standards & User Conduct

All users agree:

  • Not to harass, discriminate, or harm others.
  • Not to engage in illegal, violent, or unsafe activities.
  • To treat each other with professionalism and respect.
  • No smoking, alcohol consumption, or drug use during rides.
  • Riders must not request dangerous or illegal actions from drivers.

8. Safety Features & Zero Tolerance Policy

  • AROLUX includes features such as ride-tracking, emergency contact (SOS), and trip sharing.
  • Drivers and vehicles are vetted through background and safety checks.
  • AROLUX maintains a zero-tolerance policy toward drug and alcohol use while operating the platform.

9. Insurance & Liability

  • Drivers must carry valid personal auto insurance as required by law.
  • AROLUX provides limited liability coverage during active trips (pickup to drop-off).
  • AROLUX is not responsible for lost items, injuries, or damages unless caused by gross negligence.

10. Promotions, Referrals & Discounts

  • Promotional codes and referral programs are subject to change or cancellation at any time.
  • Misuse of promotional offers may result in account suspension or chargeback.

11. Privacy & Data Collection

  • AROLUX collects personal and location data in accordance with our [Privacy Policy].
  • Your data is used for ride coordination, billing, support, safety, analytics, and legal compliance.
  • We do not sell personal data to third parties.

12. Intellectual Property

  • All content, trademarks, code, and services provided by AROLUX are our exclusive property.
  • Users are granted a limited, non-transferable, revocable license to use the App.

13. Dispute Resolution & Arbitration

  • Any disputes shall be resolved via binding arbitration through the American Arbitration Association (AAA), except where prohibited by law.
  • Class-action lawsuits and jury trials are waived where allowed.
  • Claims must be filed within one (1) month of the dispute arising.

14. Indemnification

You agree to indemnify and hold harmless AROLUX and its affiliates against any claims, liabilities, damages, losses, and expenses arising out of:

  • Your use or misuse of the platform,
  • Violation of these Terms or applicable laws,
  • Inaccurate user data or unsafe conduct.

15. Limitation of Liability

  • AROLUX is not liable for indirect, incidental, punitive, or consequential damages.
  • Our total liability shall not exceed the amount paid for the ride giving rise to the claim.

16. Termination of Services

  • We may suspend or terminate accounts for violations of these Terms, misconduct, or fraudulent activity.
  • Users may delete their account at any time via the app or by contacting customer support.

17. Modifications to Terms

  • AROLUX may modify these Terms at any time.
  • Updates will be posted in the app, and continued use signifies acceptance.

18. Governing Law

  • These Terms are governed by the laws of the State of New York, USA.
  • Any legal actions must be filed in a court or arbitration center in New York County, NY, unless otherwise required by law.
